Current Trends in Retirement Savings and Defined Contribution Plans

In this session, Laureen Mark and Allen Knott will discuss how human behavior and changing demographics impact retirement savings and how automatic plan features are having a positive impact with plan participants and plan sponsors.

Ms. Mark is a Senior Retirement Sales Representative with Principal Financial Group, where she helps advisors and plan sponsors in the start-up to $10 million asset range. She holds an economics degree from UCLA, a 6, 7, 63 and 66 securities license and a life insurance license.

Mr. Knott is Vice President of Sales Retirement and Investor Services at Principal Financial Group, where he has worked for 16 years. He received his bachelor’s degree in finance and economics from California Polytechnic State University at San Luis Obispo.

Equity Compensation Regulatory Round-Up

Equity compensation plan administration requires compliance with tax law, securities law, corporate law, accounting rules and plan documents. In this session, Alison Wright will address selected topics the administration and legal compliance issues affecting stock option, restricted stock units and employee stock purchase plans.

Ms. Wright is a partner in the Employee Benefits Group at Hanson Bridgett LLP, where she specializes in the tax, corporate law, securities law and ERISA issues related to deferred compensation and equity compensation plans. Ms. Wright currently chairs the Brown Bag Lunch Committee of the San Francisco Chapter of the Western Pension & Benefits Council, and is a member of the board of directors of the National Center for Employee Ownership. She received her undergraduate degree from Colby College, her law degree from the University of California, Davis, and her Master of Laws in Taxation degree from New York University.

Section 1411 Certifications and Health Care Reform Reporting

Section 1411 certifications are notices from an exchange that an employee has enrolled in subsidized exchange coverage. “Pay or play” penalties are triggered by an employer’s full-time employee receiving subsidies on the exchange. How should an employer respond to a Section 1411 certification? How can potential penalties be avoided?

New draft forms and instructions for reporting health care coverage and compliance with the “pay or play” rules have been issued. This reporting obligation is mandatory for 2015, and employers must collect the data required for this reporting now. Which employers will need to report? What information must be reported in the forms, and when are the due dates? What are the potential penalties if the forms are incorrectly completed?

In this session, Elizabeth Loh and Brian Gilmore will address these and other important questions raised by these developments.

Ms. Loh is a director at the law firm of Trucker Huss, APC. Her practice focuses on health and welfare plans, in which she works on compliance, document drafting, service provider agreement reviews, COBRA and HIPAA compliance, and other health and welfare plan matters. Ms. Loh received her undergraduate degree and LL.M. in taxation degree from Georgetown University and her law and MBA degrees from Santa Clara University.

Mr. Gilmore is the lead benefits counsel at ABD Insurance and Financial Services. He assists clients on a wide variety of employee benefits issues, focusing primarily on health and welfare plans, and particularly with respect to ACA compliance requirements and strategies. Mr. Gilmore received his undergraduate degree from the University of California at Berkeley and his law degree from the University of San Francisco.
