DOL's Fiduciary Conflict of Interest:
Without question, the Department of Labor’s proposed “Conflict of Interest Rule” - which will expand the definition of fiduciary as it applies to qualified retirement plan investment advice - will be one of the most significant issues to impact the retirement landscape in many years. The regulations could produce a number of unintended consequences and will definitely have a profound impact on a substantial variety of components of the retirement industry from employee advice to rollovers to IRAs. How will we continue to explain to employees how to manage their investments, determine the appropriate savings rate, and evaluate the available options so they can save for a secure retirement? What additional hurdles will the new rule impose on internal processes, rollovers, cross-selling services, plan participants, plan sponsors, financial advisors, service providers, IRA investors, allocation models, proprietary funds, disclosures, and on other business partners serving retirement plans? Lisa Thompson, Head of Human Resources, San Francisco 49ers
Lisa Thompson is the Director, Human Resources for the San Francisco 49ers. She has a PhD in psychology and over 20 years experience in human resources and employee benefits across a diverse range of industries from small high tech start ups to large hospitality organizations to a professional sports team and an event venue. Lisa has a passion for building benefits programs that support business strategies and employee engagement.
Tucker Maxwell, Account Executive, LTC Solutions, Inc.
Tucker Maxwell is an Account Executive with LTC Solutions, Inc., as well as a long-term care insurance expert with a CLTC professional designation.
Working to support brokers and educate employers in a dynamic market, Tucker facilitates the long-term care insurance conversation among brokers, human resource professionals and employees. His past experience working as an LTC Benefit Consultant with LTC Solution’s Customer Service team lends his unique ability to understand the employee and the employer’s perspective and assists him in successfully conveying the importance of long-term care insurance as an employee benefit to all parties involved.
Tucker is a certified continuing education instructor in multiple states and has spoken to brokerage firms and associations across the country about the current and future state of the long-term care insurance market.
Tucker has a Bachelor’s Degree in Business Administration from St. Martin’s University.
Jean Ackerman, Regional Director, United States Department of Labor's ("DOL") Employee Benefits Security Administrations ("EBSA") San Francisco Regional Office
Jean Ackerman is the Regional Director in the U.S. Dept. of Labor, Employee Benefits Security Administration’s San Francisco Regional Office. She and her staff are responsible for administering and enforcing the Employee Retirement Income Security Act of 1974 (ERISA) in Northern California, Alaska, Washington, Oregon, Idaho, Nevada and Utah. Jean has nearly 30 years’ experience in ERISA enforcement. Having worked as an investigator, supervisor, and manager in EBSA’s San Francisco office, she became the Deputy Regional Director in EBSA’s New York office and the Regional Director in Boston before returning to San Francisco. She has served on a number of regional and national EBSA teams, including the team that developed EBSA’s Voluntary Fiduciary Correction Program.
Jean holds a B.A. from Swarthmore College and an MBA from St. Mary’s College of California.
Toni Brown, Senior Vice President, Capital Group
Toni Brown, CFA, is a senior vice president focused on defined contribution in the Retirement Strategy Group at American Funds, part of Capital Group. She has 25 years of investment industry experience and has been with Capital Group since 2013.
Prior to joining Capital, Toni was with Mercer Investment Consulting as a Director of U.S. Client Consulting and U.S. Defined Contribution Leader. Before that, she was an Executive Vice President of Callan Associates, with management responsibilities for the San Francisco consulting office and the firm's defined contribution practice.
She holds an MBA from Arizona State University and a bachelor's degree in general business from the University of Denver. She also holds the Chartered Financial Analyst designation.
Toni has been recognized in the 401kWire's 2012 "Hundred Most Influential People in Defined Contribution" and was honored by Al-CIO in 2013 as one of the "World's 25 Most Influential Consultants."
As a founding member and past Chair of DCIIA, Toni is a recognized industry leader in defined contribution topics. She is a frequent public speaker. Toni is based in San Francisco.
Mark A. Davis, QPFC, Senior Vice President, Financial Advisor, CAPTRUST Financial Advisors
Mark has been in the defined contribution industry for more than 25 years and has served as an independent advisor since 1999. While based in Southern California, Mark focuses on providing investment advisory services to fiduciaries of institutional retirement plans from New York to Honolulu. Mark is frequently quoted in national media and regularly speaks at events on retirement, investment and educational issues, and is a regular contributor to the Journal of Pension Benefits.
Mark has testified before both the House Ways & Means and Education and Labor Committees as well as the ERISA Advisory Council at the DOL. He recently completed two terms on the Board of Directors of ASPPA, the American Society of Pension Professionals and Actuaries and was on the founding Committee of NAPA, the National Association of Plan Advisors. He was honored with the opportunity to join the Advisory Board of the John Marshall School of Law in Chicago Center for Tax Law and Employee Benefits. Mark has been named one of the “Top 50 Retirement Advisors” by the 401kwire. He was recently a finalist for the NAPA 401(k) Leadership Award for 2015. Earlier in his career Mark was with Fidelity, Schwab, and GE Capital. Mark lives in Thousand Oaks, CA with his wife Tricia.
Nick White, Director, Trucker Huss
Nick's practice focuses on ERISA consulting, particularly with respect to tax-qualified plans. His practice includes, but is not limited to, negotiating the resolution of plan defects, prohibited transactions and fiduciary breaches under the IRS' and Department of Labor's remedial programs; advising and defending fiduciaries regarding their obligations and liabilities; and structuring qualified plan and non-qualified differed compensation arrangements. Nick also advises clients regarding the employee benefit aspects of mergers and acquisitions.
Prior to entering private practice, Nick worked for the IRS in the Employee Plans and Exempt Organizations Division (now known as the Tax Exempt & Government Entities Division or TE/GE Division), where he has served on the Technical review Staff as a Senior Reviewer for both determination and examination cases, and as a technical resource for the Division. Ultimately, Nick became a Coordinator of the IRS' Western Region Walk-in Closing Agreement Program, which is now part of the IRS' remedial program known as the Voluntary Correction Program or VCP. Prior to joining the Technical Review Staff Nick worked primarily in the Divisions determination letter program, where he issued rulings on the legal sufficiency of plan documents.
Nick is a current member of the Government Affairs Committee of the American Society of Pension Professionals and Actuaries (ASPPA), and he is a past member of both the Executive Committee and the Board of Directors of ASPPA. Nick is a current member of the Board of Directors of the LA Chapter of the Western Pension & Benefits Council (WP&BC).
Nick frequently speaks at conferences held by ASPPA, WP&BC, the National Institute of Pension Administrators (NIPA) and other industry organizations. Nick served on the Editorial Advisory Board for Thompson Publishing Company and he was the Contributing Editor for Thompson's Pension Plan Fix-it Handbook. He has also written on employee benefits topics for the Journal of Taxation, the Journal of Pension Benefits and other industry publications.
Nancy Hilu, Senior Counsel, Hanson Bridgett
Nancy counsels private and public companies, tax-exempt organizations and governmental entities on all aspects of employee benefits and executive compensation.
Nancy advises clients on the design, implementation, and continued legal and regulatory compliance of their retirement plans, including defined benefit, 401(k), 457(b) plans. She represents plans and other fiduciaries in the preparation of plan documents, amendments, policies and other participant communications. Nancy also has extensive experience working with plan sponsors and their third party administrators to resolve benefit plan compliance issues and in preparing submissions under the IRS and DOL correction programs.
In the executive compensation arena, Nancy has counseled clients with regard to designing and drafting equity incentive plans. She has also provided guidance on matters concerning employment and severance agreements, bonus programs, and non-qualified deferred compensation agreements, including compliance with Sections 409A and 162(m).
Prior to joining the firm, Nancy was an associate for a global leaders in assurance, tax, transaction and advisory services where she conducted compliance reviews of plan documents and plan operations to identify failures and process gaps that could potentially cause legal issues.
Ray Lynch, Partner, Hanson Bridgett
Ray has substantial litigation experience in state and federal trial and appellate courts. Ray's practice focuses on employment, labor and benefits litigation with an emphasis on defense of complex disputes. His practice includes class and other multi party actions. He has represented employers in the government, transportation, life sciences, utility, manufacturing, health care and financial industries. Ray's practice also includes litigating unfair competition, trade secret and environmental cases. He has argued matters before the Ninth Circuit Court of Appeals. He has tried cases in state and federal courts and before administrative agencies, including the National Labor Relations Board.
Ray has successfully conducted numerous arbitration's and has extensive labor relations experience. Ray counsels employers on the full range of employment law compliance and litigation prevention. With a master's degree in industrial relations and prior experience as a human resource manager, he brings a unique and valuable perspective to his legal practice.
