The Supreme Court’s holding that Section 3 of the Defense of Marriage Act is unconstitutional impacts all kinds of employee benefits from retirement plans to health plans to FMLA.  This roundtable discussion will focus on how employers are responding to the Supreme Court’s decision.  Discussion topics will include any or all of the following:

• Transition rules on when to stop imputing income
• Welfare plan issues, including covered dependents
  
• Retirement plan issues, including QDROs and invalid beneficiary designations
  
• Discontinuing the gross-up benefit
